POLICY FOR THE PROCESSING OF PERSONAL DATA OF CUSTOMERS<\/strong>
\nPursuant to Articles 13 and 14 of EU Regulation 2016\/679 \u2013 GDPR<\/strong>
\nLabware SpA, with headquarters at Via Enzo Ferrari, 3 \u2013 Zona Ind.le A, 62012 Civitanova Marche (MC), Tax ID and VAT No. 01424730438, in its capacity as Data Controller, hereby provides the privacy notice pursuant to Articles 13\u201314 of EU Regulation 2016\/679 \u2014 the General Data Protection Regulation (GDPR), hereinafter also referred to simply as \u201cGDPR.\u201d.<\/p>\n

1. IDENTITY AND CONTACT DETAILS OF THE DATA CONTROLLER<\/strong>
\nLabware SpA hereby notifies you that, for the purposes of establishing and managing our relationship, it is the data controller of your data classified as personal data pursuant to EU Regulation 2016\/679.

2. CATEGORIES OF PERSONAL DATA<\/strong>
\nThe Personal Data that are processed by the Data Controller include, but are not limited to: first name, last name, social security number, VAT number, residential address, place of work location, telephone number, mailing address, bank details, etc.<\/p>\n

3. PURPOSE OF PROCESSING<\/strong>
\nPersonal data, are processed by the Data Controller as part of its business:<\/strong>
\nI) Without your express consent for the following purposes:
\nI.a) Provision of services and execution of contracts<\/strong>
\nThe provision of Personal Data is necessary to provide the requested services and to fulfill contractual and precontractual obligations.
\nI.b) Administrative and management purposes and for compliance with national and EU regulatory requirements<\/strong>
\nThe processing of Personal Data to comply with regulatory requirements is mandatory and does not require consent. Processing is mandatory, for example, when required by anti-money laundering, tax, accounting, or anti-corruption laws, or by measures and requests from the supervisory and regulatory authority to which the Data Controller is subject;
\nI.c) Holder's defense<\/strong>
\nThe processing of Personal Data is necessary to pursue a legitimate interest of the Data Controller, i.e.: to establish, exercise or defend a right in court or whenever judicial authorities exercise their jurisdictional functions;

\nI Personal Data will be processed with your express consent for the following purposes:<\/strong>
\nII.a) Marketing<\/strong>
\nTo carry out functional activities for the promotion and sale of products and services through letters, telephone, Internet, SMS, MMS and other communication systems;<\/p>\n

4. LEGAL BASIS.<\/strong>
\nThe legal basis for the processing of personal data for the purposes referred to in point 3 above, Section I.a), is the performance of a contract to which you are a party or the implementation of precontractual measures taken at your request, therefore, the fulfillment of precontractual and contractual obligations with respect to legal relationships established and\/or to be established with you (Article 6(1)(b) of the GDPR).
\nThe legal basis for the processing of personal data for the purposes referred to in point 3 above, Section I.b), is compliance with a legal obligation to which the Data Controller is subject (Article 6, paragraph 1, letter c), GDPR), while for the purposes referred to in point 3, section I.c) above, it is the pursuit of the Data Controller\u2019s legitimate interests (Article 6(1)(f) of the GDPR).
\nThe legal basis for the processing of personal data for the purpose referred to in point 3 above, Section II.a), is the data subject\u2019s explicit consent to the processing of their personal data for one or more specific purposes (Article 6(1)(a) of the GDPR).<\/p>\n

5. RECIPIENTS<\/strong>
\nWithout prejudice to communications performed in fulfillment of legal and contractual obligations, all data collected and processed may be shared, exclusively for the purposes specified above, with the following categories of authorized persons and\/or internal and external managers identified in writing and to whom specific written instructions about data processing have been provided:
\n\u2022 Authorized internal personnel\u2014employees and contractors of the Data Controller, in their capacity as persons authorized to process personal data, who have committed to maintaining confidentiality or are subject to an appropriate legal obligation of confidentiality;
\n\u2022 Processors \u2013 individuals, companies, professional firms, or other third parties with whom the Data Controller maintains relationships necessary for the conduct of its business for the purposes indicated above or as required by law, to whom a specific mandate has been entrusted and for the time necessary to achieve the purposes for which the data were collected, who typically act as Data Processors for Labware SpA. By way of example, the Data Controller may need to disclose data to the following categories: entities providing professional consulting and tax, legal, and judicial assistance services; entities providing IT system management services;
\n\u2022 Third-party recipients \u2013 Judicial or supervisory authorities, government agencies, public entities, and organizations (including, but not limited to: the Italian Revenue Agency, law enforcement agencies, judicial authorities, local governments, ministries, and their collaborators\/auxiliaries), insurance companies, and banks.<\/p>\n

6. STORAGE AND TRANSFER OF PERSONAL DATA TO A THIRD COUNTRY<\/strong>
\nYour personal data is stored on servers located within the European Union. In any case,

\nIt is understood that the Data Controller, should it become necessary for technical or operational reasons, shall have the right to transfer Personal Data to countries outside the European Union for which \u201cadequacy\u201d decisions have been issued by the European Commission, or on the basis of appropriate safeguards or the specific exceptions provided for in the Regulation.<\/p>\n

7. PROCESSING METHODS AND STORAGE TIME OF PERSONAL DATA<\/strong>
\nPersonal data will be processed, in compliance with the provisions of the GDPR, using paper-based, computer-based and electronic means, using methods strictly related to the purposes for which the personal data was collected and, in any case, in a manner suitable for ensuring its security and confidentiality in accordance with the provisions of Article 32 of the GDPR.
\nPersonal data is retained for a period no longer than is necessary to achieve the purposes for which it is processed, subject to the retention periods required by law. Specifically, Personal Data is generally retained for a period of 10 years from the termination of the contractual relationship to which you are a party. Personal Data may also be processed for a longer period if an event occurs that interrupts and\/or suspends the statute of limitations, thereby justifying the extension of the data retention period.
\nPersonal data collected for marketing purposes will be processed until the data subject requests that the service be deactivated.
\nFor more information regarding the retention period for personal data and the criteria used to determine that period, please contact the Data Controller.<\/p>\n

8. RIGHTS OF THE DATA SUBJECT<\/strong>
\nIn connection with the processing operations described in this policy statement, as a data subject you may, under the conditions set forth in the GDPR, exercise the rights enshrined in Articles 15 to 21 of the GDPR and in particular the following rights:
\n\u2022 Right of access \u2013 the right to obtain confirmation as to whether or not personal data concerning you are being processed and, if so, to obtain access to your personal data, including a copy thereof (Art. 15, GDPR);
\n\u2022 Right to rectification \u2013 the right to obtain, without undue delay, the rectification of inaccurate personal data concerning you and\/or the completion of incomplete personal data (Art. 16, GDPR);
\n\u2022 Right to erasure \u2013 the right to obtain, without undue delay, the erasure of personal data concerning you (Art. 17, GDPR);
\n\u2022 Right to restriction of processing \u2013 the right to obtain from the Data Controller a restriction of processing in the cases provided for by the GDPR (Art. 18, GDPR);
\n\u2022 Right to data portability \u2013 the right to receive, in a structured, commonly used, and machine-readable format, the personal data concerning you that you have provided to the Data Controller, and the right to transmit that data to another data controller without hindrance, in the cases provided for by the GDPR (Art. 20, GDPR);
\n\u2022 Right to object \u2013 the right to object, at any time and for reasons related to your particular situation, to the processing of your personal data, unless the Data Controller has legitimate grounds to continue the processing (Art. 21, GDPR);
\n\u2022 Right to withdraw consent \u2013 the right to withdraw your consent to the processing of your data at any time, without affecting the lawfulness of processing based on consent prior to withdrawal;

9. PROVISION OF DATA<\/strong>
\nThe provision of your personal data for the purposes set forth in point 3, section I) is mandatory. Any failure on your part to provide such data, incomplete, or inaccurate provision of such data and\/or any express refusal to consent to its processing will make it impossible for the Data Controller to respond to your requests, fulfill contractual obligations or any legal obligation to which the Data Controller is subject, or comply with requests from the competent authorities.
